This writ petition has been filed seeking issuance of Writ of 1/4

Certiorarified Mandamus to call for the records connected with the proceedings issued in F.No.119/Gen/TN/92/2015-FF (SZ)-INA dated 28.04.2015 passed by the respondent and quash the same and consequently direct the respondent to disburse the arrears of pension of the petitioner's late father Thiru.Thangavel. 2.The learned counsel appearing for the petitioner submitted that the petitioner's father was a freedom fighter and he was sanctioned freedom fighter's pension by the State Government and Central Government, petitioner being second wife's son and the first wife predeceased and had no objection for granting pension in favour of the petitioner, however, the respondent passed the impugned order which is not sustainable one and further submitted that this Court may issue direction to the respondent to disburse the arrears of pension of the petitioner's late father Thiru.Thangavel to the petitioner. 3.Heard both sides and perused the materials available on record.

4.Perusal of the impugned order reveals that the petitioner's representation dated 14.03.2014 was considered by the respondent 2/4

and his request was rejected for the reason that the petitioner's father was not sanctioned any pension and his mother was also not sanctioned dependent family pension.

5.Unless the petitioner establish the sanction of pension to the petitioner's father, the petitioner is not entitled for any arrears of pension from the respondent. The writ petition is dismissed. No costs.
