Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the entire records on the file of the 2nd respondent vide proceedings in No.P.VIII02/2017-EC-1 dated 06.02.2019 and quash the same, consequently directing the 2nd respondent to reinstate the petitioner in service with full back wages from the date of suspension.

After arguing the matter at full length, on the learned counsel for the respondents pointing out to this Court that the petitioner instead of filing appeal as provided under Rule 28 of Central Reserve Police Force Rules, 1955 (in short 'CRPF Rules') had filed the present writ petition, the learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition with liberty to file an appeal as provided under the CRPF Rules. He also made an endorsement to that effect. 2/5
2. Having regard to the submission and endorsement made by the learned counsel for the petitioner and also taking note of the fact that the present writ petition is filed on 12.02.2019 against the order of dismissal of petitioner from service dated 06.02.2019 passed by the 2nd respondent, this Court is of the view that permission can be granted to the petitioner to withdraw the present writ petition with liberty to avail appeal remedy provided under the CRPF Rules, 1955. In the event of appeal being filed the time spent in pursuing the present writ petition before this Court from 12.02.2019 to today i.e., 23.09.2025 shall stand excluded in terms of Section 14 of the limitation Act.
3. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner to file an appeal under the CRPF Rules, 1955. No costs. Consequently connected miscellaneous petition is closed. 23.09.2025 Speaking order / Non-speaking order Index : Yes / No : Yes / No msv 3/5
