C.M.P.No. 3900 of 2023 IN S.A.No. 1166 of 2005 V.LAKSHMINARAYANAN, J.

The petitioner is the second plaintiff in O.S.No. 53 of 2000 on the file of the District Munsif Court at Ambattur. The suit was for purpose of partition. The first plaintiff is the mother. The suit was decreed and the appeal preferred therefrom was also dismissed. Aggrieved by the same, the Second Appeal and cross objection was preferred to this Court and in and by a Judgment dated 09.01.2017, they were dismissed.

2. Pending the Appeal, the original Will of the mother /co-plaintiff was filed and now the petitioner/respondent wants to return the same.

3. The learned counsel for the petitioner is directed to file a certified copy of the Will and on filing the same, the original Will be returned after getting the necessary endorsement from the petitioner.
