The application has been filed seeking to condone the delay of 64 days in filing the written statement.

The plaintiff and the defendant are both sisters. They seek partition and separate possession of the property acquired by their father. In the affidavit filed in support of the application, it had been stated that the petitioner had to produce certain documents which has been filed along with the written statement. In producing those documents, there has been a delay. 3.

Taking into consideration the fact that the suit is for partition between the two sisters and it would only be appropriate that adversarial litigation is not aggravated any further, the application stands allowed. The written statement of the defendant to be taken into record. 4.

List the matter under the caption 'for framing issues' on 03.07.2024. It is stated that efforts to settle the issue through mediation had failed.
