Comp.A No.60 of 2022 in CP.No.23 of 2014 KRISHNAN RAMASAMY, J., This application has been filed to direct the Bank of India, the secured creditor to remit Rs.1,17,981/- with the Official Liquidator towards publication expenses to be paid to Dina Thanthi and (b) to permit the Official Liquidator to deposit a sum of Rs.1,17,981/- to Dina Thanthi upon receipt of the same from Bank of India and (c)reimburse a sum of Rs.1,17,981/- to Bank of India, as and when sufficient funds are available to the credit of the Company in liquidation, (d) to permit the Official Liquidator to incur cost of this application from the funds of the Company.

2. According to the Official Liquidator, due to paucity of funds, the bill raised by Dina Thanthi for a sum of Rs.1,17,981/- towards publication expenses, was not processed. Further, since the learned Official Liquidator was not able to trace out the Ex-Management persons, he moved the present application, seeking to direct the secured 1/2 https://www.mhc.tn.gov.in/judis

KRISHNAN RAMASAMY, J., dn creditor, the respondent bank herein, to deposit the amount as prayed for towards publication expenses.

3.After filing of the present application, this Court ordered notice to the respondent Bank. Despite service of notice and printing the name of the respondent in the Cause list, none appeared on behalf of the respondent Bank. It shows that the respondent Bank is not interested to prosecute the application.

4.Considering the submissions made by the learned Official Liquidator and also the report filed by him, this application is ordered as prayed for.
