Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Declaration, declaring that the options given by the petitioner for question Nos.26,36,51,53,73,86 and 98 (in the 1/5

petitioner's question book series) are correct and accordingly direct the respondents to award the petitioner with marks for the said answers by appointing a Expert Committee to evaluate corrections of the key answers and select and appoint the petitioner to post of Assistant Surgeon (General) on the date when all the other candidates under the Notification issued by the respondent Board are appointed with all service and monetary benefits.

O R D E R

This Writ Petition has been filed for a declaration, declaring that the options given by the petitioner for question nos.26,36,51,53,73,86 and 98 (in the petitioner's question book series) are correct and accordingly, direct the respondents to award the petitioner with marks for the said answers by appointing an Expert Committee to evaluate corrections of the key answers and select and appoint the petitioner to the post of Assistant Surgeon (General) on the date when all the other candidates under the Notification issued by the respondent Board are appointed with all service and monetary benefits. 2/5

Heard the learned counsel appearing on either side and perused the materials available on record.

Similarly placed person already made request and the same was rejected and it was challenged before this Court in W.P.No.6881 of 2025. This Court, by an order dated 28.03.2025, dismissed the writ petition. Therefore, the prayer sought for by the petitioner cannot be considered. The writ petition is devoid of merits and the same is liable to be dismissed.

Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
