Respondent Prayer:The Criminal Revision Petition filed under Sections 397 and 401 of the Criminal Procedure Code, to set aside the order passed in Criminal Miscellaneous Petition in Cr.M.P.No.346/2015, dated 07.03.2015 on the file of the XI Additional Sessions Judge, Court for CBI Cases, Chennai, in so far as the partly rejected claim and directing the respondent to de freeze partition deed document, cash, which were seized at the time of raid from locker as well as residence, Two LIC policy certificates, Locker key and permit the petitioner to operate the other fixed deposit accounts.

O R D E R

This revision has been filed against the order of the trial court in partially allowing the petition of the petitioner to de-freeze the accounts as well as the documents, wherein, the trial court has allowed the de-freezing certain items of the accounts and the documents and rejected the contention of the petitioner in respect of the other items, as against which the present revision has been filed.

2. Heard the learned counsel for the petitioner and the learned Special Public Prosecutor for the respondent.

3. The learned Special Public Prosecutor submitted that the https://hcservices.ecourts.gov.in/hcservices/

investigation is already over and the petitioner is not figured as an accused and the documents and accounts seized and freezed are not at all required for investigation purpose and hence, he has no objection for allowing this revision.

4. In view of the above submissions, I am of the view that the petitioner is entitled to get back the documents and deposits and to de-freeze the accounts and hand over to the petitioner as prayed for.
