ORDER

This writ petition has been filed to direct the 1st respondent to give police protection to the petitioner to survey the property in Survey No.853/1, to the extent of 1.82 cents and in respect of property in Survey No.853/2 to the extent of 1.18 cents to the total extent of 3 acres situated at Manivizhanthan Colony, Thalaivasal Taluk, Salem District on the basis of the petitioner's representation dated 02.12.2025.

2.The petitioner owns the aforementioned property, which was derived through family partition and the petitioner was issued with a joint patta for the same. The 3rd respondent herein, who is owning a land on the western side of the petitioner's property, is creating disturbances over the boundaries of the property owned by the petitioner. Therefore, the petitioner submitted an application before the 2nd respondent to conduct survey in the petitioner's land,

in order to fix the boundaries. However, since there was an objection from the 3rd respondent, the 2nd respondent was unable to conduct the survey. 3.The learned counsel appearing for the 3rd respondent submitted that the 3rd respondent had already approached this Court by way of W.P.No.1484 of 2026 to consider his representation for conducting survey and sub divide the 20 feet cart track comprised in Survey No.853/1 and to lay boundaries on the corners of the property. This Court, by an order dated 28.01.2026, disposed of the writ petition with a direction to the 3rd respondent herein to submit a fresh online application with a consequential direction to the Tahsildar to survey and demarcate the boundaries of the property. Based on the order of this Court, survey was conducted and the boundaries of the 3rd respondent's land was demarcated.

4.By taking note of the aforesaid submission and the order passed by this Court in W.P.No.1484 of 2026, dated 28.01.2026, this Court is inclined to issue similar directions in the present writ petition also. Accordingly, the 2nd respondent herein is directed to survey the petitioner's land comprised in Survey No.853/1 and Survey No.853/2, except the land which was already surveyed in

respect of the 20 feet cart track in Survey No.853/1 situated at Manivizhanthan Village, Thalaivasal Taluk, Salem District. However, if any objections are raised by the 3rd respondent in respect of the survey to be conducted in the petitioner's property, the 2nd respondent is at liberty to seek police protection from the 1st respondent and on such request, the 1st respondent is directed to give police protection for surveying the subject land. 5.With the above direction, the writ petition stands disposed of.
