IN THE HIGH COURT OF JUDICATURE AT MADRAS

( Special Original Jurisdiction ) Thursday, the Twentieth day of July Two Thousand Seventeen PRESENT THE HON'BLE MR.JUSTICE S.M.SUBRAMANIAM WMP No.7866 of 2017 in WP No.7225 of 2017 R.AMUDHA [ PETITIONER ] Vs 1 THE STATE OF TAMIL NADU [ RESPONDENTS ] REP.BY THE CHIEF SECRETARY TO GOVERNMENT, CHIEF SECRETARIAT, FORT ST. GEORGE, CHENNAI -600 009.

2 THE SECRETARY, TAMIL NADU PUBLIC SERVICE COMMISSION, FRAZER BRIDGE ROAD, V.O.C. NAGAR, PARK TOWN, CHENNAI - 600 003.

3 THE REGISTRAR, ANNAMALAI UNIVERSITY, SADAGOPAN NAGAR, ANNAMALAI NAGAR, CHIDAMBARAM - 608 002.

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to direct the respondent to reserve one post of Assistant in Combined Civil Services Examination -II ( Group II-A Services) (Non-interview Posts) on preferential basis under Persons studied in Tamil Medium ( PSTM) Quota and under Women category and MBC Quota pending WP.No.7225 of 2017.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.GIRIDHAR AND SAI, Advocate for the petitioner and of MR.M.DIGVIJAYAPANDIAN ADDL.GOVT.PLEADER for the 1st respondent and of MR.M.LOGANATHAN Advocate for the 2nd respondent and of MR.V.R.KAMALANATHAN Advocate for the 3rd respondent the court made the following order:- Heard, M/s.Giridhar and Sai, learned counsel appearing for the petitioner, and Mr.M.Digvijayapandian, learned Additional

Government Pleader appearing for the 1st respondent, Mr.M.Loganathan, learned counsel appearing for the 2nd respondent, and Mr.V.R.Kamala Nathan, learned counsel appearing for the 3rd respondent.

2. At the time of admission, this Court granted an order of interim direction, directing the respondents to keep one post of Assistant in Combined Civil Services Examination - II services vacant. When certain queries were raised with regard to the Tamil Medium degree course undergone by the writ petitioner, the learned counsel wants to file certain additional documents and additional affidavit in this regard. Thus, this case requires a considerable time to complete adjudication and the parties are to be heard with regard to the issues raised.

Under these circumstances, keeping one post vacant will not serve any purpose and it will be beneficial neither to the writ petitioner nor to the public in general. Keeping the post vacant without filling the same will certainly affect the effective administration and in the event of petitioner succeeding in the writ petition suitable directions may be issued by this Court for granting appropriate relief.

Thus, the interim order granted on 24.03.2017 is modified to the extent of preserving the right of the writ petitioner for appropriate relief at the time of passing the final orders in this writ petition.

3. With the above observations, the W.M.P.No.7866 of 2017 in W.P.No.7225 of 2017 is closed. The learned counsel for the petitioner is permitted to file additional typed set and additional affidavit.

4. Post the writ petition for "final disposal" after three weeks.
