ORDER : The Court Made the following order :- The petitioner seeks bail for the offences punishable under Sections 4(1)(a), 4(1)(g) and 4(1-A) TNP Act.

2. According to the prosecution, the petitioner was found in possession of 10 liters of I.D.Arrack and 200 liters of wash, resulting in the registration of the case.

3. The learned counsel appearing for the petitioner would submit that this case has been foisted only for the statistical purpose and the petitioner has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been in custody since 14.09.2017.

4. The learned Government Advocate [Criminal Side] opposed the petition stating that the petitioner is a habitual offender and two more cases of similar nature are pending against him.

5. Having regard to the fact that the petitioner has been in custody since 14.09.2017 and taking note of the fact that the petitioner has been granted bail in the earlier two cases, I am inclined to grant bail to the petitioner, subject to the following conditions:-.

(i) The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Namakkal; ii) The petitioner shall report before the respondent police daily at 10.30a.m. until further orders.
