ORDER

The petitioner was arrested on 14.01.2026, for the alleged offences under Section 75(1) & 351(4) of the BNS read with Section 66C, 66E & 67 of Information Technology Act 2000, in connection with Crime No. 3 of 2026, seeks bail.

2. The allegation against the petition is that the petitioner became acquainted with the victim through social media and developed a relationship

with her. The victim shared her private photographs and videos with the petitioner and thereafter, the petitioner had threatened her to circulate the same on social media and by such threat, he obtained a sum of Rs.1,60,000/- from the victim and further demanded a sum of Rs.2,50,000/- from her. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner and the victim were in love with each other and due to certain misunderstandings between them, a false case has been registered against the petitioner, he also undertakes to cooperate with the investigation. He further submitted that the petitioner is in judicial custody since, 14.01.2026, hence, he prays for grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and on instruction submitted that petitioner not only threatened the victim by demanding money that he would upload the private photographs and videographs of the victim through social media, but also extorted a sum of Rs.1,60,000/- from the victim girl and demanded further Rs.2,50,000/-. He would further submit that the investigation is pending and if the petitioner is enlarged on bail at this stage, he would tamper the witnesses and evidences. Therefore, he prayed for dismissal of the petition.

5. Considering the gravity of offence, possibility of tampering the witnesses and considering the overall facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner, at this stage.
