in Crl.A.SR.No.8299 of 2023 M.SUNDAR, J and M.NIRMAL KUMAR, J (The Order of the Court was made by M.Sundar, J) Captioned 'Criminal Miscellaneous Petition' (for brevity, 'Crl.M.P') has been filed to 'condone the delay' (for short, 'CoD') of 170 days in filing the aforementioned regular Criminal Appeal, filed under Section 374(2) of the 'Code of Criminal Procedure, 1973' (for brevity, 'Cr.P.C.').
2. Mr.N.Baskaran, learned counsel for the petitioner/A1 submitted that there was difficulty in arranging funds to hire a counsel and considering the economic status of the petitioner/appellant (A1), it has hampered filing of the appeal within time.
3. Learned Additional Public Prosecutor accepts notice for sole respondent.
4. We are informed that the co-accused has filed an appeal, delay has been condoned and the appeal is in the process coming up before this Court.
5. We have perused the affidavit. Heard learned counsel for the
petitioner, learned Additional Public Prosecutor, considering the facts, circumstances and the nature of the matter, we are inclined to accept the reason for the delay. Accordingly, the delay is condoned.
