Respondent Prayer: Criminal Revision is filed under Section 397 r/w Section 401 of Criminal Procedure Code, praying to call for the records in connection with the order passed by the Judicial Magistrate Additional Mahila Court at Alandur in Criminal M.P.no.857A of 2022 on 24.01.2024 in C.C.No.259 of 2022 and the same may be set aside.

ORDER

This Criminal Revision Case has been filed challenging the order dated 24.01.2024 passed in Crl.M.P.No.857A of 2022 in C.C.No.259 of 2022 on the file of the Judicial Magistrate, Additional Mahila Court, Alandur, thereby dismissing the petition filed by the petitioner seeking discharge from the charges under Sections 294(b), 323, 498A and 506(i) of IPC.

2. While the case was pending for framing of charges, the petitioner filed a petition seeking discharge from the aforesaid charges and the same was dismissed by an order dated 24.01.2024. Aggrieved by the same, the petitioner has preferred the present Criminal Revision Case.

3. Pending the revision, the petitioner and the second respondent have amicably settled the dispute between them. The second respondent has agreed to withdraw the criminal proceedings initiated against the petitioner and other accused.

4. The learned counsel appearing for the second respondent submitted that pursuant to the settlement, the second respondent has received monetary compensation and she has no objection to discharge the petitioner and

other accused from the criminal proceedings. An affidavit has also been filed before this Court by the second respondent.

5. In view of the above, the order dated 24.01.2024 passed in Crl.M.P.No.857A of 2022 in C.C.No.259 of 2022 on the file of the Judicial Magistrate, Additional Mahila Court, Alandur, is hereby set aside. The terms and conditions set out in the Affidavit filed by the second respondent, dated 20.02.2025, shall form part and parcel of this order.
