Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the 1st respondent in connection with the impugned order passed by him in Na.Ka.No.A2(3)/ 171/1880/PV/2019 dated 24.03.2020 and quash the same and direct the respondents to appoint the petitioner as Jail warden and grant him all consequential benefits.

JUDGMENT

(Delivered by PARESH UPADHYAY, J.) 1.

Challenge in this appeal is made to the order dated 23.12.2020 recorded on W.P.No.11442 of 2020. This appeal is by the Respondents/ State Authorities.

Learned Advocate for the respondent/ writ petitioner, on instructions, states that though the writ petitioner has succeeded before learned single Judge, the writ petitioner intends to give up his plea which was agitated in the writ petition and therefore he seeks permission to withdraw the writ petition, in which, he has succeeded.

3. In view of the above, the order of learned single Judge is set aside at the concession of the writ petitioner. In view of the above, appeal would not survive and the same is dismissed. No costs.
