CMP.Nos.9376 to 9379 of 2019 in SA.No.1618 of 2004 C.KUMARAPPAN, J These petitions have been filed to condone the delay of 35 days in filing the application to set aside the abatement, application to set aside the abatement and for impleadment in the above Second Appeal.

2. Notice issued to respondents. The learned counsel for the first respondent has no serious objection in allowing these applications. In respect of the other respondents, except R11, others were served and names are printed in the cause list. Despite the names printed in the cause list, no one has appeared. In respect of R11, notice was returned as "Left". Therefore, notice to R11 is sufficient.

3. Having considered the submission made by the learned counsel for the petitioner and having satisfied with the same, this Court is inclined to allow the applications.

4. In the result, these CMPs are allowed. Registry is directed to make necessary amendment in the cause title.
