O R D E R
The petitioners seek for a Writ of Mandamus directing the respondents to regularize the services of the petitioners on completion of 10 years of services and to extend all benefits both service and monetary in the light of the decision by the Court in W.P.No.23823 of 2023 dated 19.07.2024.
2. The petitioners were appointed on daily wage basis in the respondents Department through employment exchange in the year 1996 and 1998 respectively and they have been brought under minimum time scale of pay from
the year 2019. Their names were not considered for regularisation even after completion of 10 years of service as per G.O.Ms.No.22, P and AR Department, dated 28.02.2006.
Yet another Government Order in G.O.Ms.No.74 dated 27.06.2013 was issued by the Government fixing the cut-off date as 01.01.2006. The petitioners rely on the above Government Orders and the order of this Court in an earlier writ petition in W.P.No.1550 of 2011 dated 09.03.2012, wherein, a direction was issued to consider the claim of the petitioners therein for regularisation.
3. The issue in the present writ petition is no longer res integra. A larger Bench of this Court has already dealt with the issue as to whether part time employees are entitled to regularisation as per G.O.Ms.No.74, P & AR Department dated 27.06.2013, wherein, the larger Bench of this Court by order dated 26.02.2024 held that wherever the posts are permanent in nature and if they come within 86 categories of posts which form the Tamil Nadu Basic Service, temporary or part time employment, they would be entitled for regularization. Since the petitioners are also similarly placed, this writ petition has been filed seeking the aforesaid relief.
4. The learned counsel appearing for the petitioners submitted that it would suffice, if the respondents are directed to dispose of the representation of the petitioners dated 08.10.2025 on merits and in accordance with law, within a specified period.
5. The learned Additional Government Pleader for the respondents has no objection for such an order being passed by this Court.
6. In view of the limited request made by the learned counsel appearing for the petitioners, this Court, without going into the merits of the case, directs the respondents to consider the representation of the petitioners dated 08.10.2025 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
