Respondent Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Certiorarified Mandamus calling for the records pertaining to the order passed by the Debts Recovery Tribunal, Coimbatore in I.A.No.2552 of 2023 in S.A.No.494 of 2023 dated 19.01.2024 and quash the same and directing the respondent from confirming the sale as per the sale notice dated 06.12.2023 in CB/NKLSME/SALE/VKS/JAN/2024 on merits.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.A.Maheshnath, learned counsel for the petitioner.

2. Learned counsel for the petitioner submits that the petitioner would proceed further with the application pending before the Debts Recovery Tribunal.

3. In the light of that, the present writ petition is disposed of. The petitioner may prosecute his application before the Debts Recovery Tribunal as may be permissible under law. There shall be no order as to costs. Consequently, W.M.P.Nos.4155 and 4156 of 2024 are closed.
