O R D E R

The prayer in the present petition is for direction to the first respondent to take action on the petitioner's Complaint dated 12.04.2017.

2. The grievance of the petitioner before the first respondent is that the three named persons in his complaint have trespassed into his property and cut thorny bushes therein and when he questioned the same he was man handled.

3. Today, when the matter was came up for hearing, the learned Additional Public Prosecutor submitted that the petitioner had already withdrawn the petition on 10.05.2017.

4. However, the learned counsel for the petitioner on instructions from his client has submitted that the petitioner has not withdrawn the complaint and he is still aggrieved by the said incident that had occurred.

5. In view of the same, the petitioner is granted liberty to file a fresh complaint and on receipt of the same of the respondents police shall conduct proper enquiry and file a final report as expeditiously as possible. With the above observation, the criminal original petition disposed of.
