ORDER

The wife who is the respondent in H.M.O.P.No.9 of 2021, pending on the file of the Sub-Court, Theni, is the petitioner before this Court. The petitioner wife has filed the above petition for transferring the said proceedings now pending on the file of the Sub-Court, Theni to the file of the Sub-Court, Attur. The petitioner has approached this Court seeking the transfer on the following grounds:

(a) The petitioner is residing at Attur and employed as a Staff Nurse at Government Hospital, Attur, Salem District. For the purpose of attending the hearing she has to avail leave for 2 days and this will be a great strain to her.

(b) The petitioner has been suffering from disc bulging in the spinal cord region and is not in a position to undertake a long distance travel.

2. Having heard the learned counsel and perused the records, the reasons set out supra gives sufficient grounds for transferring the petition filed by the respondent husband on the file the Sub-Court, Theni to the file of the Sub-Court, Attur.

3. For the above reasons, the Transfer Civil Miscellaneous Petition stands allowed.

Consequently, connected Civil Miscellaneous Petition is closed. No costs.
