BY THE INSPECTOR OF POLICE, PADALUR POLICE STATION, PADALUR, PERAMBALUR DISTRICT.

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition order imposed in this above Crl.O.P.No.3914/2020 dated 21.2.2020 regard to the nonrefundable deposit of Rs.1,60,000/-shall be reduced as this Honourable Court may deem fit. [CRL.MP.NO.3639/2020] Order :

This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. G.ILAMURUGU, Advocate for the petitioner and of MR. C.RAGHAVAN, Govt. Advocate ( Crl. Side) on behalf of the Respondents the court made the following order:- The learned counsel for the petitioner sought for modification to reduce the amount directed to be deposited by the petitioner in the concerned District Mineral Foundation Trust, Vide its order in Crl.O.P.No.3914 of 2020, dated 21.02.2020.

2. The petitioner is the owner of the lorry which was alleged to have been used for smuggling 8 units of river sand. Hence, this Court is not inclined to grant the modification as sought by the petitioner. In this circumstances, the learned counsel for the petitioner prayed this Court to grant some additional time to comply with the conditions imposed on the petitioner.

4. Considering the submissions made by the learned counsel appearing for the petitioner, this petition is modified only to the extent that this Court grants further three weeks time from the date of receipt of a copy of this order, in depositing the amount as was directed this Court in its order dated 21.02.2020 in Crl.OP.No.3914 of 2020.

5. If any order of curfew is imposed by the Government in that local area where the petitioner resides or where he has to make the payment and execute the bond, in view of the ongoing COVID 19 threat, such of those days during which time curfew is in http://www.judis.nic.in 1/2

force shall be deducted in calculating the time granted for complying with the conditions.
