O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5(1) and 6(1) read with Section 10 of Protection of Children from Sexual Offences Act, 2012 and Section 9 read with Section 10 of Child Marriage Act in Crime No.46 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioner is that the petitioner is ranked as A6 in this case and originally the victim girl, who is aged about 15 years was living with her mother, who is a patient and she is taking treatment. The victim girl on the advice of her grandmother and mother and also with the help of A1's sister, was forced to marry A1 in this case, however she refused to live with that person and continuously protested and further the marriage was not intimated to any other person, somehow, the victim girl contacted her maternal aunt and she intervened and rescued her and attempted to lodge a police complaint, however she was not able to lodge the police complaint and she was in the house of her maternal aunt. After knowing this situation, this petitioner and A7 went to the house of the maternal aunt and taken her and kidnapped the victim girl and brought her to the house near A1 and indiscriminately attacked her and also removed her cloth to verify whether the victim girl was having periods. A1, A6 & A7 had continuously attacked her by using wooden log and also abused her to live with the present petitioner. In the mean time, somehow, victim girl's aunt lodged the complaint, victim girl was secured.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that, A1 and A7 in this case has been arrested and the petitioner is the main accused, who caused injuries to the victim girl.

5. I have considered the rival submission and perused the materials available on record.

Considering the fact that the accused including the petitioner herein has made sexual assault against the victim girl and that if the petitioner is granted anticipatory bail, there is a likelihood that petitioner would cause prejudice to the victim girl, who is 18 years old, hence this Court is not inclined to grant anticipatory bail to the petitioner. 3/5
