A.No.448 of 2015 RAJIV SHAKDHER, J.,

1. Mr.M.Ajmal Azzath, who appears for the applicant, says an award has already been passed in the matter on 12.05.2016.

2. Learned counsel for the respondents says he has no instructions as to whether his clients have challenged the award.

3. Nevertheless, it is accepted before me by the counsel for the parties, that the property, which is adverted to in the schedule appended to the judges summons, is owned by respondent No.2, and, that, the said property stands charged to the applicant.

4. Furthermore, learned counsel for respondent No.2 says that till such time steps are taken to challenge the award and a decision is rendered by an appropriate forum in that behalf, his client will not transfer, sell, alienate and / or create any third party interest in the property referred to in the schedule.

5. According to me, this statement of the learned counsel for the respondents should suffice and consequently, protect the interest of the applicant. The said statement is taken on record.

RAJIV SHAKDHER, J., gg 5.1. Resultantly, the counsel for the applicant does not wish to press the application any further.

6. The captioned petition is, accordingly, disposed of, based on the statement of the counsel for the respondents. 04.07.2016 gg A.No.448 of 2015
