Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records of impugned order passed by the 3rd respondent vide tender reference No.CE/D/CNR/E196/2023-2024 dated 09.02.2024 quash the same and further direct the 3rd respondent to open the financial bid of the petitioner as per serial No.9 of the tender document dated 12.01.2024. The revocation of technical evaluation to Technical Bid opening of the petitioner due to administrative reasons connected to the petitioner on 09.02.2024 is under challenge in the present writ petition.
2. The learned counsel for the respondents furnished the copy of the written statement given by the Chief Engineer/Distribution, Chennai North Region, the respondents states that while verifying the NIC portal, it was observed that during floating of the tender, the bidder were insisted
mistakenly to upload the tender documents in cover I & II (Cover I: NIT Cover II: Tender documents & BOQ) instead of (Cover I: NIT & Tender documents Cover II: BOQ).
3. However, the written instructions given by the respondents would reveal that the tender proposal has been cancelled and fresh tender proposal will be initiated for the upcoming financial year. Since the tender proposal has been already cancelled, no further adjudication is required. The said information shall be uploaded in the official website of the Tamil Nadu Electricity Board.
4. Accordingly, this Writ Petition stands dismissed. No costs. Consequently, connected Miscellaneous Petition is closed. 08.04.2024 Jeni Index : Yes Speaking order
