Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the 1st respondent herein to pass appropriate orders on the application in Na.Ka.No.1023/2018/A1 and in pursuance of the enquiry held on 06.06.2018 in a stipulated and pass necessary or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

This Writ Petition is filed seeking for a Mandamus, directing the the 1st respondent to pass appropriate orders on the application filed by the petitioner under Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

2. In this Writ Petition, though the notice was issued to the respondents 2 to 5 and served on them, they have not chosen to appear either in person or their counsel. Their name is printed in the cause list today.

3. The grievance of the petitioner is that the 1st respondent has not considered the said application, even though he has chosen to conduct an enquiry on 06.06.2018.

4. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the 1st respondent to consider and pass orders on the application already pending before him.

5. Therefore, this Writ Petition is disposed of, only with a direction to the 1st respondent to consider the application filed by the petitioner and pass orders on the same on merits and in accordance with law, after hearing the petitioner, respondents 2 to 5 and other interested parties, if any. Such exercise shall be done by the 1st respondent within a period of four weeks from the date of receipt of a copy of this order. No costs.
