Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 3 to cancel the patta No.46 issued in favour of the 4th Respondent by issuing separate patta in favour of the petitioner in respect of the property bearing Survey No.25/13 to an extent of 3 cents situate at bethakoollu Village, Hosur Taluk and Krishnagiri District. By consent, the writ petition is taken up for final disposal.

The petitioner claims that he is the owner of the property admeasuring an extent of 3 cents in Survey No.25/13B in Bethakoollu Village, Hosur Taluk and Krishnagiri District by virtue of a registered sale deed dated 25.7.1980 vide document No.4115/80 on the file of the Sub Registrar, Hosur and on that land, he has put up a superstructure and is residing for the past 35 years and it is his case that due to inadvertence, he did not get patta. The grievance expressed by the petitioner is that including his patta land, a patta came to be issued in favour of the fourth respondent as anganwadi building and to review the same, the petitioner submitted a representation on 19.2.2015 to the respondents 1 to 3 and though it was acknowledged, he has not been favoured with any response and hence, he came forward to file the present writ petition.
3. Heard the submissions of Mr.C.Prabakaran, learned counsel appearing for the petitioner, Mr.RM.Muthukumar, learned Government Advocate, who accepts notice for respondents 1 to 3 and Mr.R.Vijyakumar, learned Additional Government Pleader, who accepts notice for the fourth respondent.

This court, after considering the limited scope of relief sought for, without going into the merits, directs the third respondent to consider the representation dated 19.2.2015 on merits and in accordance with law, after putting on notice the persons concerned and pass order as expeditiously as possible not later than a period of eight weeks from the date of receipt of copy of this order and inform the decision taken to the writ petitioner.
