8. Govindasamy .. Respondents Writ petition filed under Article 226 of the constitution of India to issue a writ of mandamus to direct the respondents 1 to 4 to consider the petitioner's representation dated 13.11.2017.

For Petitioner: Mr.S.Ambigapathi For Respondents: Mr.R.Govindasamy, Special Government Pleader for R1 to R4 No appearance for R5 to R8

O R D E R

The petitioner seeks for a mandamus directing the respondents 1 to 4 to consider his representation dated 13.11.2017, wherein and whereby, the petitioner sought for cancellation of patta issued in favour of the respondents 5 to 8 and grant the same in favour of the petitioner.

2. Perusal of the said representation indicates that the same was addressed to the 1st respondent alone and not to the 3rd respondent, who is the competent authority to consider the present issue by way of an appeal. Therefore, this Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the 3rd respondent to consider and pass orders. Therefore, the petitioner is directed to make a fresh representation/ appeal before the 3rd respondent within a period of two weeks from the date of receipt of a copy of this order. If any such appeal is filed, the 3rd respondent shall consider the same and pass orders on its own merits and in accordance with law within a period of twelve weeks thereafter, after hearing the petitioner, the respondents 5 to 8 and also the other interested parties, if any.

3. With the above direction, the writ petition is disposed of. No costs.
