The petitioner, who was arrested and remanded to judicial custody on 06.02.2022 for the alleged offences punishable under Sections 8(c) read with Section 20(b)(ii)(C), 25 and 29(1) of NDPS Act in Crime No.06 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with others accused were found in possession of 60 kgs of Ganja. Hence, the case.

3. When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) submitted that very recently this Court dismissed the bail in Crl.O.P.No.30236 of 2022 dated 23.12.2022. He would submit that the petitioner along with other accused were found in possession of 60 kgs of Ganja, which is a commercial quantity. He further submitted that this petitioner is having one previous prohibition case pending against him.

Taking into consideration the facts and circumstances of the case, also considering the fact that this Court very recently dismissed the earlier bail petition in Crl.O.P.No.30236 of 2022 dated 23.12.2022 and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, the Criminal Original petition is dismissed with the direction to the learned II Additional Special Judge for NDPS Act Cases at Chennai, to complete the trial within a period of five months from the date of receipt of copy of this order.
