Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus or any other appropriate order or direction directing the respondents to pay interest amounts to the petitioner for the belatedly paid Provident Fund, Leave Salary and commutation of pension amount at the rate of 6% per annum for 11 1/4

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction against the respondents to pay interest for the belated payment of Provident Fund, leave salary and commutation of pension. The petitioner claims interest to be paid for 11 months for the period of delayed payment.

2. In the affidavit filed in support of this Writ Petition, it has been contended that the petitioner was appointed as a driver in the respondent transport corporation on 11.01.1989. He retired on attaining the age of superannuation on 30.06.2022. It had been stated that the retirement benefits were settled only on 23.05.2023. Claiming interest for the delayed payment of retirement benefits, the petitioner had given a representation on 27.01.2025. Since the same has not been considered, the present Writ Petition has been filed.

A direction is given to the respondents that in view of the fact that they had settled the retirement benefits to the petitioner after a delay of 11 months, they are liable to pay interest for the delayed period of 11 months at 6% per annum. The respondents may discharge this liability within a period of 4 months from the date of receipt of a copy of this order.

4. With the above directions, this Writ Petition stands disposed of. No costs.
