Petition against the wilful disobedience of the order dated 25.6.2014 made in M.P.No.2 of 2014 in W.P.No.3922 of 2014.

O R D E R

The petitioner has come up with this petition alleging that the order of this Court dated 25.6.2014 made in M.P.No.2 of 2014 in W.P.No.3922 of 2014 has not been complied with by the respondents.

2. When this matter came up for hearing on 22.12.2015, it was submitted by the learned counsel for the petitioner that the petitioner was not permitted to report for duty. When this was informed to the learned counsel for the respondents, it is submitted that the petitioner did not report for duty on his own and if he reports for duty, he would be allowed to join duty.

3. Having heard the same, this Court directed the petitioner to report for duty on 28.12.2015 before the Assistant Executive Engineer, Tiruppur.

The learned counsel for the petitioner submitted that the petitioner would report for duty on 28.12.2015. Mr.N.Mani, Superintending Engineer/South, TANGEDCO, Coimbatore, who was present before the Court, submitted that if the petitioner reports for duty, they would entertain him. Recording the said undertaking, the matter was adjourned today.

4. Today, when the matter was taken up, the learned counsel for the respondents submitted that on 28.12.2015, the petitioner did not report for duty. On 29.12.2015, the petitioner called an official of the respondent and wanted him to inform the address of the office where he should come and report. The address was so given. Even thereafter, the petitioner did not turn up for duty. The learned counsel for the petitioner would submit that he received an information from the Public Information Officer on 23.12.2015 stating that there is no such office address at Periyar Nagar, Tiruppur, as given in the transfer order. In my considered view, the contempt is a matter between the Court and the alleged contemnor. In this case, it is quite obvious from the conduct of the petitioner that he is not willing to report for duty under one guise or other. He is simply trying to harass respondents/officials by further perpetuating this contempt petition. Therefore, this petition is dismissed.
