ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 294(b), 341, 324, 506(2), and 307 of IPC in Crime No.45 of 2022 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on the date of occurrence, the defacto complainant was brutally attacked by the petitioners. Hence, the complaint.
3. The learned counsel for the petitioner has submitted that the petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he pleads for anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl.Side) has opposed on the ground that brutal attack with deadly weapons by the petitioners to the defacto complainant has caused 13 stitches on his head and the defacto complainant miraculously escaped from death.
5. From the FIR, this Court finds that due to money transaction, enmity was prevailing between the defacto complainant and the petitioner and as a consequences, the accused persons have restrained the defacto complainant and attacked him with deadly weapons all over his body.
6. Taking note of the fact that the petitioners' abscondance is causing hindrance to the investigation.
Accordingly,this Criminal Original petition is dismissed.
