The petitioner/A1 who was arrested and remanded to judicial custody on 05.01.2024 for the offences registered by the respondent police under Sections 417, 312, 506(ii) IPC and Section 4 of TNPHW Act and subsequently, altered to Sections 417, 312, 376, 506(ii), 420, 120B of IPC and Section 4 of TNPHW Act in Crime No.74 of 2023, seeks bail.
2.There are four other accused who are still absconding. 3.The learned counsel for the petitioner stated that a plain reading of the FIR would reveal that the entire relationship between the petitioner and the defacto complainant was consensual. However, the defacto complainant had given a statement under Section 164(5) Cr.P.C and a reading of it shows a tale of agony. She had been led to believe that this petitioner would marry her and on that promise, they had physical relationship. Thereafter, she was forced to abort the child, though she was not willing to do so. This abortion had created further medical complications and thereafter, the accused had stated as to why she is still living.
