(CR.NO. 97 OF 2013) Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.434 of 2022 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner in S.C.No. 309 of 2014 on the file of the Learned XVIII Additional Sessions Judge , Chennai dated 07.09.2021 enlarge the petitioner on bail pending disposal of the CRL.A.434 of 2022. (CRL.MP.NO.5275/2022) This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.A.434 of 2022 on the file of the High Court and upon hearing the arguments of M/S. M.VIJAYA KUMAR Advocate for the petitioner and of MR.LEONARD ARUL JOSEPH SELVAM,Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(crl.side) appearing for the respondent police.

2. It is the submission made by the learned Government Advocate (crl.side) that during the time of trial before the trial court, the petitioner is in the custody. Further, the petitioner is having seven previous cases, in which one case is registered for the offence punishable under Section 302 of IPC.

3. Therefore, considering the previous antecedents of the petitioner, this Court is not inclined to entertain this petition seeking suspension of sentence. Accordingly, this petition in Crl.MP.No.5275 of 2022 is dismissed.
