ORDER

This writ petition has been filed, challenging the impugned order dated 25.01.2025 passed by the respondent rejecting the petitioner's application seeking for issuance of patta in her favour for the property, morefully described

in the prayer to this writ petition on the ground that the litigation is pending over the very same property.

2.The petitioner has filed this writ petition on the ground that the impugned order is a non-speaking order.

3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondent.

4.This Court has perused the impugned order. As seen from the same, excepting for stating that the property for which patta is sought for by the petitioner is the subject matter of litigation, the details of litigation have not been disclosed in the impugned order. Being a non-speaking order, necessarily, the impugned order has to be quashed and the matter has to be remanded back to the very same respondent for fresh consideration, on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner.

5.This Court is not expressing any opinion on the merits of the petitioner's application seeking for issuance of patta in her name for the property, morefully described in the prayer to this writ petition.

6.For the foregoing reasons, the impugned order dated 25.01.2025 is quashed and the matter is remanded back to the respondent for fresh consideration, on merits and in accordance with law. The respondent shall give due consideration to the supporting documents filed by the petitioner and through a speaking order, pass final orders, on merits and in accordance with law on the petitioner's application seeking for issuance of patta in her name for the property, morefully described in the prayer to this writ petition, after affording an opportunity of personal hearing to the petitioner, within a period of 12 weeks from the date of receipt of a copy of this order. Consequently, connected WMP is closed. No costs.
