ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 294(b), 323, 417, 420 and 506(ii) of IPC in Crime No.7 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner herein is running a un-registered chit fund and cheated several persons. Therefore, the case has been registered against the petitioner and her husband for the offence under Sections 294(b), 323, 417, 420 and 506 (ii) of IPC .
3. The learned counsel for the petitioner has submitted that the petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl.Side) has submitted that as of now, the respondent police have received three other complaints apart from this FIR and the petitioner and other accused are absconding and disturbing the prosecution to proceed with the investigation and the amount cheated also could not be recovered.
5. Taking note of the fact that the petitioners' abscondance is causing hindrance to the investigation and custodial interrogation is required for proper investigation, this Court is not inclined to grant anticipatory bail to the petitioner.
