Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, forbearing the respondents from insisting the petitioner and his customers either to obtain transport permits or to get the bills issued by the Public Works Department mentioning the final place of destination of the petitioner's customers for transporting the sand from the stockyard of the petitioner at S.F.No.819-ID2, 819-2 Santhaipettai, Thirukkoilur Taluk, Villupuram District to the place of petitioner's purchase destination. The prayer in the writ petition is for issuance of a writ of Mandamus, forbearing the respondents from insisting the petitioner and his customers either to obtain transport permits or to get the bills issued by the Public Works Department mentioning the final place of destination of the petitioner's customers for transporting the sand from the stockyard of the petitioner at S.F.No.819-ID2, 819-2 Santhaipettai, Thirukkoilur Taluk, Villupuram District to the place of petitioner's purchase destination.
2. The Government has amended Rule 38(c) of the Tamil Nadu Minor Mineral Concession Rules, 1959 and regulated the transport of sand by obtaining permission from the authority concerned. Rule 38(c) of the said Rules has been challenged before this Court in a batch of writ petitions in W.P.No.14180 of 2011, ETC.
IN THE CASE OF M.PALANISAMY VS. THE STATE OF TAMIL NADU wherein
this Court upheld the amended Rule 38(c) of the Tamil Nadu Minor Minerals Concession Rules 1959 and dismissed the writ petitions.
3. The learned counsel for the petitioner fairly submitted that the writ petition has become infructuous.
4. In view of the above, writ petition stands dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
