ORDER : The Court Made the following order :- The petition is filed seeking anticipatory bail for the offences punishable under Sections 34 & 498-A of IPC, in Crime No.81 of 2021, registered by the Inspector of Police, Mahila Thana Police Station, Raipur, Chattishgarh.

The learned counsel appearing for the petitioners prays for inter-state anticipatory bail for the period of four weeks, so as to enable the petitioners herein to approach the concerned Magistrate and seek regular bail.

The reasons stated by the petitioners herein is that this petitioners are mother-in-law and father-in-law of the defacto complainant who are aged about 60 years, residing at Souramangalam, Salem District. Their son viz., Chiranjeevi who married to the defacto complainant, is presently at Singapore, carrying on his
profession. Due to matrimonial distort, the defacto complainant lodged this complaint before the Mahila Thana Police Station, Raipur, Chattishgarh, making certain allegations which are denied. Apprehending arrest at the hands of the Inspector of Police, Mahila Thana Police Station, this petitioners seek for interstate anticipatory bail.

Normally this Court will be very hesitant to grant inter state anticipatory bail, in view of the fact that this Court is not in a position to get the background of the case for which the anticipatory bail is sought for. However, prima facie in this case, this Court is satisfied for entertaining the inter state anticipatory bail on the ground that these petitioners are senior citizens and the First Information Report produced by the petitioners herein indicates, the matrimonial dispute between the defacto complainant and her husband, who is presently in Singapore. The defacto complainant has also initiated proceedings under Section 125 Cr.P.C., seeking maintenance.

Accordingly, the inter-state anticipatory bail for a period of four weeks is granted on condition that each of the petitioners shall surrender before the learned Judicial Magistrate-I, Salem, within a period of seven days from today and each of the petitioners shall execute a bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioners shall approach the competent Court in Chattishgarh and seek appropriate relief. -sd/- 03/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
