ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.11.2025 for the offences under Sections 296(b), 109 of BNS ( 294(b), 307 of IPC), Section 4 of Tamil Nadu Prohibition of Harassment of Women Act in Crime No.389 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that this petitioner is having sexual relationship with the victim and when she refused to continue the relationship with this petitioner, she has attacked him on three occasions and also threatened her with dire consequences. It is alleged that during the previous two occasions the victim has got severely injured Hence the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he is in judicial custody from 22.11.2025. He further submitted that the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court . Hence, prays to grant bail.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted the petitioner has attacked the victim and caused injuries to her and if the petitioner is released on bail, he will indulge in similar type of offence in future. Hence, he opposed to grant bail to the petitioner.

5.Considering the submissions made by the learned counsel appearing on either side; the fact that the petitioner has attacked the victim girl on three occasions and the previous two occasion the victim was severely injured and if he is released on bail he will indulge in similar type of offence, hence this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition stands dismissed. 12.02.2026 smn To
