PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to provide water and drainage connection to the petitioners' property at Plot No.42-A, Shree Nivas, 1st Main Road, Customs Colony, Thoraipakkam, Chennai-97 by considering the representation sent by the 2nd petitioner on 29.11.2017 to the 1st respondent.

ORDER

Mr.M.Jothikumar, learned Standing Counsel accepts notice for the respondents. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioners seek an innocuous relief to direct the respondents to provide water and drainage connection to the petitioners' property at Plot No.42-A, Shree Nivas, 1st Main Road, Customs Colony, Thoraipakkam, Chennai-97 after considering the representation sent by the second petitioner on 29.11.2017 to the first respondent.

3. The learned counsel for the petitioners submits that the respondent Board is bound to provide water supply and sewerage https://hcservices.ecourts.gov.in/hcservices/

connection to the petitioners, as it has been provided for their neighbours.

4. It appears that on account of on-going construction adjoining the petitioners' property, the line has to pass through in front of the petitioners' property and that at the behest of those third parties, the request made by the second petitioner is not being considered.

5. The learned Standing Counsel for the respondents, on instructions from the second respondent, would submit that if the water line is passing through the property of the petitioners, then, the connection will be given provided the petitioners make an application in the proper format. The learned Standing Counsel would further submit that the application can be downloaded from the official website of the respondent Board.

6. Recording the said submission, the writ petition is disposed of by directing the petitioners to make an application in the proper format to the second respondent/Competent Authority along with necessary fees. If such an application is made, the second respondent shall consider the same and effect water and drainage connection to the petitioners' property as expeditiously as possible, preferably within a period of six weeks from the date of receipt of such application. No costs.
