ORDER

This writ petition has been filed for issuing a writ of mandamus directing the respondents to consider the application submitted by the petitioner on 26.11.2024, wherein, the petitioner has sought for correction of her name as "S. LAVANYA" instead of "AYSHA.S" in the birth certificate issued to the petitioner's daughter by the Greater Chennai Corporation.

Heard Mr.J.Athiamaan, learned counsel appearing on behalf of the petitioner and Mr.E.C.Ramesh, learned Standing Counsel appearing on behalf of the respondents.

The name of the petitioner is S.Lavanya and the same is evident from the birth certificate that was issued to her when she was born on 19.12.1984. The petitioner was married to one Syed Nazrullah, who belongs to the Muslim community. The marriage was conducted under the Special Marriage Act, 1954 and it was registered on the file of the Sub Registrar Office, Pallavaram. A child was born and while issuing the birth certificate, the name of the petitioner was mentioned as "Aysha.S" instead of "S.Lavanya". Hence, the petitioner submitted an application before the respondents seeking for correcting her name in the birth certificate that was issued to the petitioner's daughter. Since the same was not considered, the present writ petition has been filed before this Court. 4.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the third respondent to carry out the necessary correction in the birth

certificate by incorporating the name of the petitioner as "S.Lavanya" instead of "Aysha.S", who is the mother of Maryam Iqra .S.N and issue a fresh birth certificate within a period of four weeks from the date of receipt of a copy of this order.
