ORDER
The petitioner, who was arrested and remanded to judicial custody on 05.11.2025 for the alleged offences punishable under Section 7 read with Section 8 of the Protection of Children from Sexual Offences Act, 2012, Section 118(1) of BNS, 2023 and Section 75 of the Juvenile Justice (Care and 1/5
Protection of Children) Act, 2015 in Crime No.70 of 2025, registered on the file of the respondent police, seeks bail.

The allegation against the petitioner is that he is the paramour of the victim's mother and taking advantage of his proximity to the victim, he committed sexual assault by inappropriately touching her private parts, and it was intimated to the victim's father and, based of the complaint lodged, a case was registered and the petitioner was arrested.

The learned counsel appearing for the petitioner submitted that it is not a case of sexual assault as stated in the complaint and that the case has been foisted due to motive at the instance of the victim's father. He further submitted that the petitioner is ready to co-operate with the trial process. Hence, he prays to grant bail to the petitioner. 4.
The learned Government Advocate (Crl.side) reiterated the prosecution case and submitted that the statement of the victim girl has been recorded and the final report was also filed in Spl.S.C.No.301 of 2025 on the file of the learned Sessions Court, Magalir Neethim Mandram (Fast Track Mahila Court), Tiruppur. Hence, he opposed to grant bail to the petitioner.
5. On perusal of the statement of the victim girl, it is alleged that the petitioner committed sexual assault by inappropriate touching her private parts. However, it is not a case of penetrative sexual assault or aggravated penetrative sexual assault. Considering the period of incarceration and the fact 2/5
that the investigation was completed and the final report filed and the same was taken on file in Spl.S.C.No.301 of 2025, this Court is inclined to grant bail to the petitioner.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Magalir Neethim Mandram (Fast Track Mahila Court), Tiruppur , and on further conditions that:
[a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall report before the concerned Court daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation. [c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate 3/5
action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
