ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.01.2026, for the alleged offences punishable under Sections 126(2), 296(b), 125, 309(4), 311, 351(3) of BNS Act 2023, in Crime No.266 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner, along with two other accused committed a robbery of Rs.1,250/- from the defacto complainant at knife point using filthy language.

The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he had not committed any offence as alleged by the prosecution. He further submitted that the petitioner was inside the prison from 14.01.2026. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent, on instruction submitted that the petitioner, along with the other accused, waylaid the defacto complainant and demanded money, when he refused, they robbed Rs.1,250/- at knife point and escaped from the scene of occurrence and the case property has been recovered. It was further submitted that the petitioner is having eight previous cases and the investigation is still in

progress.

Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel, investigation in this case is pending and also considering the fact that 8 previous cases are pending as against the petitioner, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 11.02.2026 gbi
