Defendants Prayer: Civil Suit is filed under Order IV Rule 1 of the High Court of Madras,Original Side, 1956 R/W O VII R1 of CPC, prayed for a judgment and decree against the defendants ; a) for recovery of a sum of Rs.1,00,00,000/- as damages as against the defendant with future interest at 18% per annum from date of filing of the suit and till date of realization for having published a defamatory article about the plaintiff, b) for a permanent injunction restraining 1/4

the defendants, their men, agents, servants, person or persons claiming through them from publishing any article concerning the plaintiff, his family, his private life, private life of his family members, his business activities carried on by him lawfully, in " Dinamalar"., a daily Newspaper without ascertaining the truthfulness from the plaintiff.

JUDGMENT

Both sides counsel appeared through video conferencing.

2. The learned counsel for the plaintiff has submitted that the matter has been settled between the parties out of court and he requests to dismiss the civil suit as settled out of court and to that effect, he filed memo also.

3. The learned counsel for the defendants also submitted that the matter has been settled between the parties.

4. Recording the aforesaid submissions and also the memo filed, this civil suit is dismissed as settled out of court. The Registry is directed to re-fund the court fee as per rules.
