This Writ Petition has been filed seeking for issuance of a Writ of Mandamus to direct the respondents to issue Patta to the petitioners as per G.O.Ms.No.34, Revenue (LD1(2) Department, dated 23.01.2008, by considering the petitioner's representations dated 13.08.2012 and 30.08.2012 in Survey Nos.237/1, 481/2A, 482 part, 485/2 and 496 in Sadyankuppam Pattai, Thiruvottiyur village as per the list annexed in the typed set of papers.
2. The learned Additional Government Pleader takes notice
for the official respondents. In view of the limited relief sought for in this petition and on the consent expressed by the learned counsel appearing for either side, this petition is taken up for final disposal.
3.The case of the petitioners is that the petitioners are in occupation in Survey Nos. 237/1, 481/2A, 482 part, 485/2 and 49 in Thiruvottiyur Village. As the Government came forward to issue G.O.Ms.No.34, Revenue (LD 1(2)) Department, dated 23.01.2008, petitioners made representations dated 13.08.2012 and 30.08.2012, however, till date no orders have been passed. Hence, this writ petition is filed.
4.The learned counsel for the petitioners submitted that, it would suffice, if this Court issues a direction to the respondents to consider the petitioners representations dated 13.08.2012 and 30.08.2012 in accordance with law and pass appropriate orders within a particular time frame that may be fixed by this Court.
5.The learned Additional Government Pleader appearing on behalf of the respondents submits that the petitioners representations dated 13.08.2012 and 30.08.2012 will be considered by the respondents within the time frame that may be fixed by this Court.
6.Considering the facts and circumstances, without going into the merits of the case, the 3rd and 4th respondents are directed to consider the petitioners representations dated 13.08.2012 and 30.08.2012 and pass orders on merits and in accordance with law, after providing opportunity of hearing to the petitioners and aggrieved parties if any, within a period of twelve weeks from the date of receipt of a copy of this order. 7.With the above direction, this Writ Petition is disposed of. No costs.
