C.M.P.Nos.5053, 5057 & 5059 of 2019 in A.S.No.31 of 2013 S.M.SUBRAMANIAM.,J These petitions are filed to condone the delay of 8 days in filing the petition to set aside the abatement caused due to the death of the deceased appellant; to set aside the abatement caused due to the death of the appellant and to bring on record the legal heirs of the deceased appellant and rank them as Appellants 2 to 4. 2.This Court is satisfied with the reasons stated in the supporting affidavit. The petition in C.M.P.No.5053 of 2013 to condone the delay of 8 days in filing the petition to set aside the abatement caused due to the death of the appellant is allowed and the delay is condoned. The abatement caused due to the death of the appellant is set aside and C.M.P.No.5059 of 2019 is allowed. Proposed Appellants 2 to 4 are ordered to be brought on record as legal representatives of the deceased appellants as respondents 2 to 4 in the Appeal and the petition in C.M.P.No.5057 of 2019 is allowed. 06.12.2019 (1⁄2) mrm Note: Office is directed to carry out the necessary amendment in the grounds of appeal.
