O R D E R
The petitioner, who was arrested and remanded to judicial custody on 14.06.2026, for the alleged offence punishable under Sections 64(1), 67(1)(A) of IT Act and Section 6 of POCSO Act in Cr.No.182 of 2025 on the file of the respondent police, seeks bail. 1/5
2. The case of the prosecution is that the defacto complainant is the son of the victim women. It is alleged that the petitioner sexually assaulted the complainant's mother by having intercourse with her and the same was captured as videos and photos on his mobile phone and he transmitted the said obscene videos and images to the complainant's mobile number through whatsapp. It is further alleged the petitioner also sexually assaulted another victim girl, who is aged about 17 years, by having sexual intercourse with her on various occasion, which led to the registration of the case. Based on the same, the petitioner was arrested. Hence, the present petition has been filed by the petitioner for seeking bail.
3. Earlier, this Court vide order dated 01.09.2025 in Crl.O.P.No.23091 of 2025 dismissed the petitioner's anticipatory bail petition for the following reasons:
" 5. Considering the statements of the victims, one minor girl, another elderly lady, recorded under Section 183 of BNSS, the modus operandi of the petitioner herein while committing the crime was disclosed. Considering the nature of the offence and the fact that the investigation is yet to be completed, this Criminal Original Petition stands dismissed". 2/5
4. The learned counsel appearing for the petitioner submitted that the petitioner is in incarceration for a substantial period. Now, the trial is also progressing and all the witnesses were examined and it is pending for examination of Investigating Officer. He further submitted that the petitioner is ready and willing to abide by any conditions that may be imposed by this court. Hence, he prayed for grant of bail to the petitioner.
5. The learned Public Prosecutor (Puducherry) appearing for the respondent police reiterated the prosecution case and vehemently opposed for grant of bail to the petitioner.
6. Heard both sides and perused the materials available on record.
7. Considering the fact that now the trial itself is progressing and it reached the final stage of examining witnesses and it is also the case of two victims and also considering the gravity of the offence, I am not inclined to grant bail to the petitioner.
8. Accordingly, this Criminal Original Petition is dismissed. 25.02.2026 Vv 3/5
