JUDGMENT

The suit is filed for declaration and for mandatory injunction.

2. Learned counsel for the plaintiff filed an application in

A.No.2699 of 2016 in CS.No.212 of 2012 seeking permission to withdraw the suit, as the dispute between the parties has been settled out of court.

3. In view of the above submission and also considering the reasons stated in the affidavit filed in support of the application, A.No.2699 of 2016 is allowed as prayed for and the plaintiff is permitted to withdraw the suit. Accordingly, the civil suit is dismissed as settled out of court. Registry is directed to refund half of the court fee to the plaintiff.
