This writ petition has been filed by the petitioner to call for the records from the second respondent relating to the Charge Memo bearing Ref.Memo No.DC-4/71066/2002-3 dated 04.03.2005 and the order of the second respondent proceedings No.DC-4/71066/2002-3 dated 23.11.2011, quash the same and consequently direct the respondent to restore the petitioner's pay but for the punishment and consequently direct the first respondent to consider and promote the petitioner as Junior Assistant, on the date when his immediate junior S.Balasubramanian, Work Assistant was promoted as Page No.2 of 5

Junior Assistant in terms of the promotion order dated 26.06.2012 vide Board's Proceedings No.PNT.1/18518/07 read with the Seniority list dated 04.08.2009 Board's Memo No.PNT.2/5768/09, with monetary, consequential and attendant benefits together with interest at 12% p.a. from the date of the money became due.

2. When the matter was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner is not pressing this writ petition. Therefore, the learned counsel sought permission of this Court to withdraw the present writ petition and he has also made an endorsement to that effect in the case bundle.

3. In view of the above submission coupled with an endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed.
