This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records on the file of the fourth respondent in letter dated 13.01.2021, in Letter No. K.K.Na./B1/2664/ 2016, and quash the same and direct the third respondent to register the sale deed in favour of the petitioner with respect to LIG flat bearing No: C-8/10 8th floor, 384 LIG Ramapuram Self Financing 2/6
Scheme.
2.The learned counsel appearing for the petitioner submitted that the petitioner was allotted LIG flat bearing No: C-8/10 8th floor, 384 LIG Ramapuram Self Financing Scheme. Initially the allotment is for 570 sq.ft. and thereafter, the allotment was more than 600 sq.ft. and the petitioner is ready to pay the difference in cost, however, the respondent issued the impugned letter demanding a sum of Rs.6,28,264/- which is not sustainable one.
3.This Court inorder to ascertain the total difference in cost, posed a question to the Tamil Nadu Housing Board as to the total difference in cost and the learned counsel appearing for the Tamil Nadu Housing Board replied that the total outstanding due is Rs.4,55,893/- including the interest, however, in the impugned order, it is wrongly mentioned as Rs.6,28,264/-. The learned counsel further submitted that if the petitioner pay a sum of Rs.4,55,893/-, sale deed will be executed in favour of the petitioner. 4.Since the learned counsel appearing for the Tamil Nadu Housing Board submitted that the total outstanding due is 3/6
Rs.4,55,893/- including the interest, however, in the impugned order, it is wrongly mentioned as Rs.6,28,264/-, this Court directs the petitioner to pay a sum of Rs.4,55,893/-, within a period of four weeks from the date of receipt of a copy of this order. On receipt of the said amount, the Tamil Nadu Housing Board, is directed to execute sale deed in favour of the petitioner, without demanding any further amount from the petitioner.
5.The writ petition is disposed of with the above observation. No costs.
