O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420, 506(1) of IPC in Crime No.330 of 2024, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioner is that the petitioner was running hospital in a premise own by A2 in this case and he has come forward to permit the defacto complainant to set up a pharmacy, and due to covid, he agreed to hand over the entire premises to defacto complainant and after renewing the hospital license and collected a sum of Rs.36 lakhs, however, he neither handed over the premises not returned back the money. . Hence, the case.

The learned counsel for the petitioner submitted that the transaction alleged against the petitioner is only civil transaction and due to covid, he is not able to hand over the same, however the defacto complainant instead of approaching the civil Court, he has lodged a criminal complaint against the petitioner. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner. 2/4

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner with the intention to cheat the defacto complainant, had collected a sum of Rs.36 lakhs and still he is running the hospital in the premises and with the help to A2 created trouble to the defacto complainant, who is having pharmacy in the premises. He further submitted that investigation is pending. Hence, he opposed for grant of anticipatory bail to the petitioner.

On perusal of the materials, it revealed that, petitioner induced the defacto complainant to part with Rs.37 lakhs with a promise of handing over the hospital along with the equipment and other things, however he has not repaid the money or not come forward to execute the same and now he colluded with A2, attempted to disposes the defacto complainant from the premises. In view of the same, considering that huge money is involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
