This petition is filed to condone the delay of 170 days in filing the writ appeal against the order dated 28.08.2019 made in W.P.No.17222 of 20100. 2.Mr.T.K.S.Bharathy, learned counsel accepts notice on behalf of the respondent-1.

3. Though the respondent-2 is served with notice, there is no representation on behalf of him either in person or through counsel.

4. Heard the learned Government Counsel for the petitioner/appellant and the learned Counsel appearing for the respondent-1.

5. The learned Counsel appearing for the respondent-1 has got no serious objection for condoning the delay.

6. Upon hearing the submission made by the learned Government counsel for the petitioner/appellant and the learned counsel for the respondent-1 and on being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay stands condoned and the petition is allowed.

7. The Registry is directed to number the appeal, if it is otherwise in order and the list the same for admission.
